Gabe Travers, through Neon Expeditions LLC and the associated brand Gabe Travels (“Gabe Travels,” “we,” “us,” or “our”), acts as an independent travel advisor affiliated with EnchantAway, Inc. (“EnchantAway”, “host agency”). These Booking Terms & Conditions (“Terms”) govern the relationship between Gabe Travels and you, the traveler(s) and/or purchaser(s) (“you,” “client,” or “traveler”) for all travel planning and booking services.By asking us to book travel, paying any deposit, or signing a payment authorization or proposal, you confirm that:
You have read, understood, and agree to these Terms;
You are at least 18 years old and authorized to act for all travelers on the booking; and
You will share these Terms with any other travelers in your party.
If you do not agree, please do not proceed with bookings through Gabe Travels.
We act as an intermediary and booking agent for various third-party travel suppliers, including but not limited to:
Airlines, cruise lines, tour operators
Hotels, villas, resorts, vacation rentals
Ground transportation providers, activity operators, insurance companies, and other vendors
These third parties are referred to in these Terms as “Suppliers.” We do not own, operate, manage, or control the Suppliers and we do not provide the travel services ourselves.
When we confirm a booking, you are entering into one or more contracts directly with the applicable Suppliers, and those Suppliers’ own terms and conditions will also apply to your booking. Our services are limited to travel planning, advising, and arranging bookings with Suppliers on your behalf.
Each Supplier has its own terms and conditions (for example: fare rules, payment policies, baggage rules, resort policies, cancellation and change rules, and refund rules). Those Supplier terms are binding on you in addition to these Terms.
We will provide links to, or copies of, the Supplier terms on request or where reasonably available.
By proceeding with a booking, you agree to read and comply with all applicable Supplier terms.
If there is a conflict between these Terms and a Supplier’s terms, the Supplier’s terms typically control with respect to that Supplier’s travel service (for example, cruise contract, airline contract of carriage, hotel rules).
We are not responsible if a Supplier’s terms or policies change after booking.
All quotes are subject to change until payment is accepted and a booking is confirmed by the Supplier:
Prices may change due to availability, currency exchange rates, taxes, fuel surcharges, and other factors beyond our control.
Unless specifically noted otherwise, quotes do not include:
Travel insurance
Visas, passports, or other travel documents
Resort fees, city taxes, gratuities, incidentals, or optional activities
We will always use reasonable efforts to honor quoted prices, but we cannot guarantee Supplier pricing or availability.
You are responsible for reviewing all documents (quotes, invoices, confirmations) and promptly notifying us of any discrepancies.
Payment schedules will be shared in your proposal, invoice, or booking confirmation and may vary by Supplier.
Deposit: A deposit may be required to secure reservations. Deposits may be non-refundable and are subject to Supplier rules.
Final payment: Final payment is due by the specified due date. Failure to pay on time can result in cancellation by the Supplier, with partial or complete loss of amounts already paid.
Late bookings: For bookings made close to departure, payment in full may be required immediately before we can confirm.
We typically collect cardholder details through EnchantAway’s secure systems, not by email or text. Full card numbers and security codes are stored and processed by the host agency and its payment providers, not by Gabe Travels.
You may be asked to sign a separate payment authorization form that:
Identifies the card by brand and last four digits,
Describes the trip,
Itemizes the deposit, final payment, and any other authorized charges, and
References these Booking Terms and the Supplier terms.
By providing a card and signing an authorization, you:
Confirm you are the cardholder or an authorized user;
Authorize us, EnchantAway, and the Suppliers (where applicable) to charge your card as described in the authorization and on your invoice; and
Authorize use of the card for Supplier payments, change or cancellation fees (if you have agreed to that in writing), and any agency fees disclosed to you.
We may decline to secure or ticket travel until required authorizations are signed and payment is collected.
If you request a cancellation or change:
You may be subject to Supplier fees, penalties, or fare differences, which can be substantial or result in no refund at all.
Many airline tickets, cruise fares, and promotional rates are non-refundable or only partially refundable.
For a change or cancellation to be effective, you must:
Submit your request in writing (email is acceptable) to us; and
Receive written confirmation from us that we have received and processed your request.
We will assist in processing changes or cancellations with the Supplier, but we do not guarantee that a Supplier will honor any request or provide refunds or credits.
Suppliers may modify or cancel your arrangements for reasons such as operational needs, lack of participation, government actions, weather, strikes, or other circumstances beyond our control. If a Supplier changes or cancels your services:
Our responsibility is to assist you in understanding your options as provided by the Supplier (rebooking, vouchers, refunds, etc.).
Any refunds, credits, or rescheduling are subject to the Supplier’s policies.
We are not liable for additional costs such as extra hotel nights, meals, or transportation resulting from such changes.
We strongly recommend that you purchase travel insurance (trip cancellation, trip interruption, medical, evacuation, baggage, and other coverages) for all trips.
Insurance coverage, terms, exclusions, and claims are governed solely by the insurance policy and insurer’s terms.
You are responsible for reading the full policy and confirming that the coverage meets your needs (including any pre-existing condition and destination requirements).
If you decline travel insurance, you acknowledge that you may be solely responsible for any financial loss due to trip cancellation, interruption, medical issues, or other events.
We are not an insurance company and do not decide claims.
You are responsible for:
Accuracy of information
Providing full legal names (exactly as on passports/IDs), dates of birth, contact information, and other details.
Verifying all confirmations and documents immediately upon receipt and reporting any errors promptly.
Passports, visas, and entry requirements
Ensuring that all travelers have valid passports, visas, and required travel documents for all destinations, including transit points.
Checking entry requirements (including health-related restrictions) with official government and embassy sources.
Health, fitness, and special needs
Confirming with your medical provider that you are fit to travel and participate in planned activities.
Disclosing any disabilities, medical conditions, or special needs that may require accommodation.
Checking for any recommended or required vaccinations or prophylaxis.
Behavior during travel
Complying with Supplier rules, local laws, and reasonable instructions from guides and staff.
Suppliers and we reserve the right to refuse service or terminate participation for behavior that is unsafe, disruptive, or illegal, with no refund.
Travel may involve risks, including but not limited to: illness, injury, accidents, pandemics, changes in government policies, terrorism, crime, natural disasters, transportation disruptions, and other hazards.
By booking through Gabe Travels, you:
Acknowledge that you understand the risks associated with your chosen destination(s) and activities;
Accept these risks voluntarily on behalf of yourself and any minors or other travelers you represent; and
Agree that, to the fullest extent permitted by law, Gabe Travels, Neon Expeditions LLC, EnchantAway], and their owners, employees, and independent contractors are not liable for:
Acts or omissions of Suppliers or other third parties;
Personal injury, illness, death, property damage, or other loss arising out of or related to your travel, except to the extent caused directly by our own gross negligence or willful misconduct.
You agree to release, indemnify, and hold harmless Gabe Travels and Neon Expeditions LLC from claims, losses, damages, or expenses (including reasonable attorneys’ fees) arising out of your actions, omissions, or breach of these Terms, except where prohibited by law.
We and the Suppliers may be excused from performance or liability in whole or in part if performance is prevented or materially impacted by events beyond reasonable control, such as natural disasters, wars, strikes, civil unrest, government actions, public health events, or other force majeure circumstances.
In such cases, the Supplier’s policies will determine what options (if any) are available (rebooking, credits, refunds, etc.), and our role is to assist you in understanding and exercising those options.
You retain your legal right to dispute charges with your card issuer; however, these Terms set expectations for how we handle concerns.
If you have questions or believe there is an issue with any charge, you agree to contact us first in writing and allow a reasonable opportunity for us to investigate and respond before initiating a chargeback.
We may share copies of your signed payment authorizations, booking confirmations, invoices, and these Terms with your card issuer as evidence that you authorized the transaction(s).
Nothing in these Terms is intended to waive your statutory rights under applicable consumer protection laws, including any rights related to chargebacks or card disputes.
Depending on the trip and Supplier, travel documents may be issued electronically or physically (e-docs, e-tickets, vouchers, or app-based documents).
You are responsible for downloading, storing, and traveling with required documents (digital or printed).
Please review all documents immediately upon receipt and notify us of any errors right away.
We are not responsible for losses resulting from your failure to review or retain documents, or from incorrect information you supplied.
We collect and use personal information only as needed to:
Provide travel planning and booking services,
Share necessary information with Suppliers and our host agency, and
Comply with legal and regulatory requirements.
Our full privacy practices are described in the Gabe Travels Privacy Policy, available at: https://www.gabetravels.com/privacy-policy. By using our services, you consent to our use and sharing of your information consistent with that policy.
Our services are intended for adults (18 years and older). If you book travel for minors, you represent that you are their parent or legal guardian or have appropriate authority to act on their behalf, and you accept these Terms for them.
We reserve the right to refuse service or terminate the relationship where:
There is abusive or inappropriate behavior toward our staff,
There is suspected fraud or misuse of payment methods, or
You repeatedly fail to comply with these Terms or Supplier rules.
We may update these Terms from time to time. The version in effect at the time you make a booking or sign a payment authorization will apply to that booking. For significant changes, we may post a notice on our website or notify clients with active bookings where required.
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect to the extent permitted by law.
